In the Federal Register on February 14, 2019, the United States Environmental Protection Agency (US EPA) and the Department of the Army published proposed rulemaking for public comment to define the scope of waters federally regulated under the Clean Water Act (CWA). The intent of this proposal is to review and revise the “Waters of the United States” (WOTUS) definition to help increase CWA program predictability and consistency by adding clarity to the WOTUS definition. The WOTUS definition process started in early 2017 via Executive Order, where there have been significant changes to the original proposal. This comment period on the WOTUS definition lasts until April 15, 2019. Moody and Associates representatives will be tracking the progress of this future rulemaking.
